Chapter 7 Bankruptcy
When you cannot pay you debt, Chapter 7 "liquidation" bankruptcy can help you discharge some types of debt. Not everyone qualifies for Chapter 7 bankruptcy. If you make more than the median income, you cannot file for Chapter 7. Contact me to discuss your case. I will help you determine if you qualify, and how to proceed.
Minimum Chapter 7 Process
- Get a certificate of Counseling from an approved agency.
- Complete the Bankruptcy Forms.
- Provide certain Documents, to be sent to trustee.
- File the case & pay fees.
- Receive the Notice from The Bankruptcy Court (about 10 days after filing).
- Attend 341 creditor's meeting and answer questions (will be assigned to be held about 5 weeks after filing).
- Get a certificate of Debtor Education from an approved provider.
- Receive discharge of dischargeable debts (issued about 70 days after creditor's meeting).
- Case closes when the trustee has completed his tasks.
Chapter 13 Bankruptcy
Even if you make more than the median income in Washington, you can file Chapter 13 Bankruptcy. You will set up a payment plan to repay debts while continuing to make current payments on things such as your mortgage or car loan. These plans can last between 36 and 60 months, and many times, the remaining debt is discharged at the end of the plan.
Minimum Chapter 13 Process
- Get a certificate of Counseling from an approved agency.
- Complete the Bankruptcy Forms.
- Provide certain documents, to be sent to trustee.
- Produce a Chapter 13 Plan and Complete Trustee Sheet.
- File the case & pay fees.
- Receive the Notice from the Bankruptcy Court.
- Make first payment within 30 days of filing.
- Attend 341 creditor's meeting and answer questions.
- Get a certificate of Debtor Education from an approved provider.
- Send copy of Tax returns & financial information to trustee annually.
- Make Plan payments for 36 to 60 months, complete the plan.
- Receive discharge of dischargeable debts.
- Case closes when the trustee has completed his tasks.
